Some employers track employee hours worked in 15 minute increments, and the FLEA allows an employer to round employee time to the nearest quarter-hour. However, an employer may violate the FLEA minimum wage and overtime pay requirements if the employer always rounds down.
The law requires that employers pay their workers for every hour they're on the job but it allows employers to use a certain amount of rounding when calculating the total amount of time worked. The “7-minute rule” applies in many rounding situations.
Some employers track employee hours worked in 15 minute increments, and the FLEA allows an employer to round employee time to the nearest quarter-hour. However, an employer may violate the FLEA minimum wage and overtime pay requirements if the employer always rounds down.
Minus 7 minutes is the accumulative time allowed. Meaning you could be 2 minutes late to start, go over lunch by 2 minutes, then still clock out 3 minutes early. If you exceed 7 minutes total, you will not meet your scheduled hours for the day and could get dinged.
The policy is as follows. If an employee is one minute late they will be docked 15 minutes of pay. For each additional 5 minutes after the first minute late the employee will be docked an additional 15 minutes pay.
With that being said, occasionally showing up 5 minutes late is not the end of the world. If it's regular, that's one thing. But 15 minutes is a quarter of an hour, which is simply far too much to miss. In some workplaces, being 15 minutes or later is considered half of an absence.
Because FLEA does not explicitly state that more than eight hours in a day would constitute overtime, OSHA does not limit the number of hours per day an employee can work, nor does OSHA have a regulation for consecutive days worked.
What is an Extended/Unusual Shift, and when are they used? A normal work shift is generally considered to be a work period of no more than eight consecutive hours during the day, five days a week with at least an eight-hour rest.
