Motor carriers must: Retain the logs and supporting documents for 6 months from the date they receive them.
Hours-of-Service Driver logs and supporting documents must be retained for six months.
Both the Driver Qualification and Safety Performance History Files must be retained for as long as the safety-sensitive individual is employed by the company, and for three years thereafter.
Who needs a Driver Qualification File? Any driver who operates a vehicle with a OVER/GCR of 10,001 pounds or more, transports at least 8 passengers including the driver, or who transports hazardous materials that require placarding is required to have a file containing their qualification documents.
Drivers shall keep their records of duty status current to the time shown for the last change of duty status. (2) Entries made by driver only. All entries relating to a driver's duty status must be legible and made by the driver.
6.4.4 Driver's Record of Duty Status (RODS) (395.8) Every driver needs to prepare a record of duty status for each 24-hour period. Failure to record, complete, or retain the log, or knowingly falsifying logs or other reports, makes the driver and/or carrier liable to prosecution.
Driver logs and supporting documents must be retained for six months.
In its simplest form, an electronic logging device or ELD is used to electronically record a driver's Record of Duty Status (RODS), which replaces the paper logbook some drivers currently used to record their compliance with Hours of Service (HOS) requirements.
If an ELD malfunctions, drivers can use paper logs for up to 8 days. FMCSA officials say that a driver can apply for an extension if the ELD isn't functioning by then and will look at every situation on a case-by-case basis.
