Not all leases are able to be transferred. Check with your leasing company to determine if you are able to transfer your lease to someone else. Step 2: Find a party to take over your lease. You may know a family member, friend, or coworker who wants to take over your lease.
Instead, you can legally transfer your rental lease by assigning it to a new tenant, or you can sublease your home to another renter until your lease is up. You should get your landlord's written permission for an assignment or sublease, especially if your current lease prohibits lease transfers.
Answer. Under a typical lease assignment, you transfer all of your space to someone else for the entire remaining term of the lease, and the new tenant pays rent directly to the landlord. If the new tenant fails to pay rent or damages the rental, your landlord could look to you for compensation.
Landlords can refuse consent if the proposed new tenant cannot provide good references or has no previous trading history. However, the landlord may give consent subject to conditions (but any conditions must themselves be reasonable.) Of course the tenant may not agree with the landlords reasons if consent is withheld.
Most leases require the consent of the Landlord before the lease is transferred. When a transfer of lease is prepared, through an agreement called 'Deed of Consent to Assignment of Lease', both the current Tenant and incoming Tenant are required to sign, as well as the Landlord.
When you move out prior to the end of the lease, the landlord has a legal obligation to try to rent your unit again as quickly as possible. However, if landlord manage to find the new tenant to you apartment, you won't pay rent, cause double-charged rent is illegal. You can help your landlord in finding a new renter.
Lease transfer fees range from $35 to $595. Most finance companies charge these fees. A finance company also must approve the credit of the person taking over a lease. Some finance companies charge credit application fees ranging from $25 to $250.
Swapalease charges $59.95 to register as a buyer, and Leaseholder charges subscription rates of $9.99 per month for a six-month minimum, $14.99 per month for three months, $19.99 per month for two months, or a flat fee of $34.99 for one month.
