Every employer covered by the Fair Labor Standards Act (FLEA) must keep certain records for each covered, nonexempt worker. There is no required form for the records, but the records must include accurate information about the employee and data about the hours worked and the wages earned.
Under the Fair Labor Standards Act (FLEA) you must: For at least two years, keep basic employment and earning records like time cards, wage-rate tables, shipping and billing records, and records of additions to or deductions from wages.
The Equal Employment Opportunity Commission says employers should keep all employment records for at least one year from the employee's date of termination. The federal age-bias law requires that you retain payroll records for three years.
Employers have to keep time and wages records for 7 years. Time and wages records have to be: readily accessible to a Fair Work Inspector (FWI) legible.
The Department of Labor (DOL) Wage and Hour division specifies that payroll records need to be retained for three years; payroll tax records, such as unemployment taxes, need to be kept for four years; and some states, like California and New York, and agencies like ERICA, require some records be kept for six years.
