What is an Affidavit of Documents? An Affidavit of Documents is a list of relevant documents that relates to the issues in your case. Relevant documents are documents that may help your case or damage the other party's case. The documents should have some relevance to the issues in the case.
In general, an affidavit is a written statement made by a person who swears under oath that the statement is true. An affidavit of service, also sometimes called a proof of service affidavit, is a type of affidavit that relates to legal documents that are filed with a court as part of a legal proceeding.
An affidavit is generally characterized as a voluntary, written statement taken under an oath, witnessed as well as signed by an authorized official, and used for the purpose of evidence in the court.
The Affidavit of Service, also known as proof of service, is a sworn testimony signed by the process server. It is supporting delivery of case-related papers to one or more parties in a legal matter. It certifies service of a notice, summons, writ, or process.
Step 1: Decide what the title of your affidavit will be. Step 2: Put the name and personal background information of the person giving the information in the first paragraph. Step 3: Write an opening sentence in the first person tense. Step 4: Make an outline of the information given or state the facts of the case.
You must bring sufficient identification and show it to the notary in order to establish that you are who you claim to be. A minor may sign an affidavit.
A notary can usually be found at a bank, legal supply store or law office. Attach the affidavit to the applicable legal document, and file the document in accordance with the procedural requirements in the particular jurisdiction.
In the Supreme, County and City Courts, the Affidavit of Service must be filed by 20 days or less from the date the papers were left or mailed whichever is later. Service is finished 10 days after the filing and the defendant's time to Answer starts to run.
