REQUIRED FORM OF DONATION — IN GENERAL Each charitable contribution must be in writing and must contain the following information: (1) the name of the committee making the donation; (2) the name, address, and business address of each individual, individual's employer, and each political action committee of which the committee member is a member, if any; (3) the amount of each contribution; or (4) if the contribution is in cash, in a manner approved by the appropriate agency, the amount of each contribution in cash [ ] C. REQUIREMENTS FOR CONTRIBUTIONS — ELECTED OFFICIALS Only elected officers may accept contributions for political purposes; however, contributions by non-elected employees or former employees of state agencies and school boards should be made only if the recipient of the contribution is an elected official. An employee should be the agent for a corporate donor to reimburse the state agency or school board for any reimbursement it may receive under the Employee Retirement Income Security Act. The amount of the reimbursement should be no less than 10 percent of the employer's contribution. For this purpose, the term “employer” includes one who provides the taxpayer with direct or indirect benefit whether such benefit is tangible or intangible and whether such benefit is provided through a contract or a contract-for-performance agreement. The term “employee” includes only the state employees who qualify as state officials under title I or II of this Act and the term “political office” means office in, or an office with responsibility for, a state agency or school board. In the case of a political action committee (PAC) that has been established pursuant to § 44-34-2 for a particular candidate or an election, a contribution by an employee who is a member of such PAC may only be made pursuant to a written contract with that candidate's authorized official agent in an amount up to the value of the annual cost of the employee's health care for any individual in the household of the candidate. However, a contributor whose spouse is enrolled as an employee and who is providing health care coverage directly to the spouse of a candidate may make a contribution to the spouse of that candidate.
