The proposed rule would have required that all passenger manifests for all vessels or aircraft to be operated by or under the sole control of U.S. CBP or its authorized partner agency, for transportation to, from, or within the United States (with limited exceptions). Since then, the U.S. government (including its component agencies) has published a number of technical comments on this proposal. The Department of Homeland Security (DHS) is reviewing these comments and is working with the U.S. Coast Guard and other government agencies to respond to the concerns raised, as they relate to the impact this proposal would have on U.S. immigration policy. DHS has also proposed that, consistent with section 662 of the Tariff Act of 1930, the Department of State (DOS) remove the mandatory requirement for electronic manifests for air carriers and aircraft operators who have entered into contracts in a foreign country with the DOS. However, in light of the comments received, DOS is proposing to incorporate the FAA requirements into DOS regulation in the near future. The Department has determined that the proposed rule does not provide a rational justification for its inclusion of a mandate for use of electronic passenger manifests that would have a detrimental effect, not only on U.S. immigration policy, but also on U.S. immigration-related and other business practices. Department of State (DOS) COMMENTS: This Department response to USCIS's March 5, 2005, Notice of Proposed Rule making, No. 05-1022, provides technical and operational comments responding to the proposed electronic passenger manifests, and reiterates DOS's opposition to the proposal. While reviewing the comments received on the proposed rule, DOS has been informed by the U.S. Government Accountability Office (GAO) that they will be providing a “Fact Sheet” at the beginning of the GAO's public rule making proceedings on the issue of electronic passenger manifests. Consequently, DOS does not intend to respond to this issue in this response. However, as noted above, the proposed rule remains pending for GAO's adjudication and should be finalized at the conclusion of the rule making process. The Department is working with DOS to determine its next steps in response to the GAO's announcement.
