Write in plain English. There are no legal magical words. Be clear and unambiguous. Along the same lines, you also want to make sure that your agreement makes logical sense. Draft an agreement that can grow with you. Include a provision for omitted property. Be creative.
The law does not require a person to have a lawyer to create a separation agreement. Some spouses, citing expense, consider creating their own separation agreement without a lawyer. Separation agreements can be quite complex, as you might imagine.
A lot of banks will let a customer come in and have something notarized there at the bank. And a lot of UPS stores and postal stores like that have notaries on staff. That's a way to get it notarized. As long as your document is written, signed, and notarized, then you're going to have a binding separation agreement.
Even if it signed by both parties and witnessed, it is not considered a valid document in the eye of the courts, and therefore it can be overturned. A properly executed separation agreement has several factors.
You can't force someone to sign a separation agreement. If you are wanting to resolve things, but the other doesn't, you have a few options. First, you can get a lawyer. Second, you can suggest mediation (either with or without lawyers), or a collaborative practice approach.
Separation Agreements in Virginia. Separation agreements have to be signed to be enforceable. It is customary, but not legally required, that they be notarized.

Obviously, you cannot just take a picture of your signature on a piece of paper, crop it, and paste in your documents to use it for making the documents legal; this method will not provide any decent level of evidence as someone else can easily copy-paste it from your document to another document.
