By this act, it is clarified that the PNP's approval of cross-border remittance will be considered as approval of sender, rather than recipient, for purposes of Anti-Money Laundering/Counterfeiting Act (AML/CFT Act). In this respect, remittances to the Bank of the Philippine Islands are exempted from AML/CFT Act (AML/CFT Act, in effect since November 2009, and Anti-Money Laundering Act (AMLA), in effect since December 2011). However, the act may require the PNP to provide the Bank of the Philippine Islands with the sender's details before the remittance to Bank of the Philippine Islands can be processed. In addition, as of March 2016, PNB was included in AML/CFT Act's list of “Money Services Businesses” and has implemented provisions requiring the PNP to provide the PNR system to identify and locate foreign-sender and foreign-receiver, and to share this information with the BPI for its AML/CFT purposes.
Section 5. Prohibition on Use of Cross-border Remittance.
With respect to the cross-border remittance, it is prohibited to:
Use the same electronic fund transfer system (hereinafter, “system”) or similar instrument or means of electronically transferring funds among different foreign destinations;
Send or receive money using a financial institution based within the Philippines and/or a foreign jurisdiction and/or using electronic fund transfer system(s), credit card or electronic account based instruments and/or similar mechanisms;
Create, use, or operate a financial institution or similar system;
Possess, use, or utilize electronic funds transfer system, a system that uses bank, card, or payment card payment and/or similar instrument(s), electronic payment instruments, credit-card payment processing system(s) or similar instruments, electronic account(s) using bank, card or payment card payment system(s) and/or similar instrument(s) and/or similar mechanisms.
