The applicant is a person who is a permanent resident of this state and who is not prohibited from further employment, participation in any professional, charitable or recreational activity, or from purchasing or renting any permanent dwelling or any permanent improvement thereon in a state other than this state. Minnesota Statute 147.0391 applies to persons residing in the Metropolitan Council area. A person may apply for a residency permit under sub. 1 for the duration of the residency if that person pays the fee required for a residency permit. The application must be submitted at least 90 days before the date the applicant wishes to begin residing in Minnesota and if the applicant is a student, the application must be submitted at least 60 days before the date of commencement of attendance. If any applicant fails to meet the 90 days or 60 days residency requirement the application may be denied. If an applicant's application is denied the denial does not invalidate the application. Upon application a license to practice medicine or practice as a physician assistant is issued in accordance with a valid Minnesota residency permit. A medical condition which requires a physician (or advanced practice Registered Nurse) to travel a significant distance, as determined by the physician, to obtain treatment for that condition is not regarded as a residency requirement or as qualifying for a license. SECTION 6. Statute: 703.010, et seq., entitled RESIDENCY IN THE METROPOLITAN CONGRESS, AS AMENDED BY ARTICLE II OF SECTION 477.010 OF THE TITLE 7 OF THE MINNESOTA STATUTES, UNIFORM CODE — MICHIGAN, 2013 Section 4. Residency in the Metropolitan Council area: Requirements. (1) A person may apply for a residence permit in the Metropolitan Council area to become an eligible resident. The applicant and the Metropolitan Council shall prepare a joint application. The application must be submitted to the metropolitan board of health not later than the date the application is accepted. (2) A physician shall be a resident of the metropolitan district only when practicing medicine, surgery or dentistry. A nurse shall be a resident of the metropolitan district only when practicing nursing, home medicine or chiropractic. (3) The metropolitan board of health shall not issue or renew a residence permit until it determines that an applicant meets the minimum residency requirements under SS. 703.010, et seq. The residency examination shall be administered by the board at the examination site.
