Today's question is what is temporary protected status and how is it different from asylum temporary protected status also referred to as TPS is a temporary immigration benefit provided by the United States government for individuals from a country that has been designated by the US government to receive protected status TPS allows Nationals of a designated country to remain in the United States until a specific date it allows them to apply for a work permit and in some cases it even allows Nationals of a particular state to apply for permission to leave the United States return to their home country and then return to the United States without fear of being turned away at the border United States government recently designated Nepal as a country for temporary protected status currently USCIS is accepting applications from the poly TPS and in order to qualify an individual has to show the following things one that he or she has continuously resided in the United States since June 24th 2015 — that the individual is a national of Nepal if an individual is somebody who is stateless for example a Tibetan refugee or a Bhutanese refugee it's still possible to received Nepali TPS if you can show that the country that you last habitually resided in what's Nepal and finally an individual has to show that they have not been convicted of a felony or two misdemeanors in the United States or that they are inadmissible to the United States on any other security related ground rupee access granted on a case-by-case basis so this means you have to actually physically apply for TPS in order to receive TPS the last state that you can say that again okay sorry there was a little bump in the microphone TPS is granted on a case-by-case basis, so this means that in order to receive TPS you have to actually physically apply for TPS the last date that individuals from Nepal can apply for TPS is December 24 20:15, so this means that if your application for TPS is not received by that date you will not receive TPS so what's the difference between TPS and asylum well the critical difference is that temporary protected status is just that it's temporary whereas Asylum provides a grantee with the right to remain in the United States permanently if an individual from Nepal feels that they may qualify for both TPS and Asylum it's possible for them to apply for both benefits one upside of doing this is that if an individual from Nepal is granted Nepali TPS and then the United States government continues to extend a temporary protected status for Nepal which they've historically done for other countries that have been designated for TPS then if that individual ultimately was not granted their Asylum status they would still potentially be in a protected status under TPS I'd love to hear any questions you may have about TPS asylum or any other immigration matter you can contact us through our website, and please don't forget to subscribe to our YouTube channel
