For each full-time student enrolled for study at an eligible institution; if the student was employed at least 30 hours a week and is paid during the workweek, the student is considered to work full-time. The student must be paid at least the Federal minimum wage (for workers at least twenty-one years old) during every workweek in order to be eligible for this deferment. In order to be eligible to receive the unemployment benefit during the weeks that the student is in school, the student must have had the maximum number of hours of service for a number of consecutive weeks during the study years. Exceeding the maximum hours of service requires a minimum of an additional 30 hours of service during the weeks that the student is not receiving the unemployment benefit. For instance, if a student is employed at least fifty hours a week in the study year (i.e., more than thirty hours a week of part-time work), the student will not be eligible for this deferment if he or she works less than thirty hours a week (i.e., at least ten hours of non-study-related work). In order to be eligible for both this deferment and the Federal Extended Unemployment Compensation (EUC) program, the student must show two of the following three indicators: The student is eligible to receive the Federal Extended Unemployment Compensation as defined above. The student is unable to work due to a serious health condition or injury. The student is employed during a period of national or local economic hardship. In order to maintain eligibility for both this deferment and the Federal Extended Unemployment Compensation (EUC) program, the student must meet all the conditions listed above. To apply for this deferment, you must submit a completed and signed Form 5304 and attach one of the following documents. Form 5304, Employment History Questionnaire (PDF) Job Descriptions and Status Information (PDF) Statement of Current Employment or Educational Activity (PDF) Please click on the links below to access instructions for using this online form.
