Contact Support
There are at least two parties involved in a contract: the promise, promise and, sometimes, a third party beneficiary may be named. Each party has a different obligation to the contract terms. The beneficiary in a contract generally does not have the same level of responsibility for the contract's performance.
A contract party or contracting party is an individual or business who enters into a binding agreement with another contracting party, thus accepting the obligations, responsibilities, and benefits specified within the agreement.
Edit to add — In contract law you need two parties to create a contract, you will generally think of yourself as the first party and the other party to the contract as the second, but that's just a matter of perspective. One is not labelled as such. Anyone not directly involved in the contract is then a third party.
To address this issue, the provision should name the parties or create the defined term Parties and define it to mean only the signatories. A party to a contract can indeed preclude intended third-party beneficiaries from bringing a claim under the contract.
A third-party beneficiary, in the law of contracts, is a person who may have the right to sue on a contract, despite not having originally been an active party to the contract.
Contract Name. Typically, abbreviated, this is the title commonly used to identify the contract. ... The contract name identifies the particular contract that an individual buys.
It is intended to designate what position the signer holds at the company, in order to give evidence that this person is authorized to sign on behalf of the company. To clarify, the word Title or the word Its is where the person signing puts the name of his or her position with the company the or she represents.
A contract can be entered into only by an individual (called a sole proprietor or just a proprietor), a corporation, a limited liability company (LLC) or a partnership. ... So it cannot enter into contracts. You must use your corporation's full legal name at the beginning of the contract and above your signature.
In law, these are all called “legal persons” or “legal entities.” “Travel Trails” is not a legal person or legal entity. It is just a trade name or a “doing business as” name, which is usually abbreviated to “DBA.” So it cannot enter into contracts.
A “doing business as” or DBA can help distinguish your products in the marketplace, but be aware that a DBA is just a convenient alias and shouldn't be used as a substitute for the company's legal name in official or contractual documents.
