You cannot literally force an employee to eat, but you can require that employees take time away from work during the lunch period. To enforce this rule, shut down operations for 30 minutes to an hour, if possible, and schedule staggered lunch hours to ensure continuous coverage.
Do I have to take 1-hour lunch break?
California wage and hour law requires employers to provide lunch or meal breaks to employees who work a minimum number of hours. Under Labor Code 512, non-exempt employees who work more than 5 hours per day must receive a minimum meal break of 30 minutes.
Can I refuse my lunch break?
If you are doing work for your employer, your employer must pay you. If you are on an unpaid lunch break, you cannot legally be doing work for your employer. Some states mandate some paid breaks, some industries or particular jobs may have mandated breaks (think truck driver for one).
Do you have to take a lunch if you work 8 hours?
Employers must provide employees with at least a 30-minute meal break for every 8 hours of continuous work. In addition, employees must be provided with at least a 10-minute rest break for every 4 hours worked in a day. If the employee's total work time is 3 ½ hours or less, then a break is not required.
Do you have to take a lunch if you only work 6 hours?
