Joining a Class Action — What Does “Certifying a Class” Mean? Class certification is for a class action lawsuit, and it helps to associate a plaintiff with the lawsuit through similarities in factors of the individual damages and the larger case.
Many class actions settle before going to trial. When a class action lawsuit settles, a fund may be established by the defendant to compensate the victims. The judge presiding over the lawsuit will review the settlement to determine if it provides fair and adequate compensation to the class members.
Small claims actions cost considerably less and often involve little more than a small filing fee and another fee to serve documents on the opposing side. Typically, in a civil lawsuit, it can cost $1,500-$5,000 to initiate an action and have a lawyer deliver a Statement of Claim.
Oppose class certification by citing individualized issues that Plaintiff raised to resist dismissal. V. Argue that the existence (not the amount) of damages is an individualized issue that precludes class certification.
Procedure. Depending on the state procedure, a class is certified after the court initiates this process or the plaintiff files a motion to this effect. Certification means that the court has determined that a class action is the best option to manage the multiple claims.
Class Certification Motions: More Than Tangentially Related to the Merits. Under the Circuit's old standard, a Rule 23 certification motion would likely be treated as non-dispositive, meaning that supporting documents could be kept under seal based on a good cause showing.
