The federal Fair Labor Standards Act (FLEA) determines what activities count as work time, for which employees must be paid. Attendance or participation is voluntary and not required for your job. The training takes place outside of regular work hours. The training is not job-related.
Is it legal to require unpaid training?
In general, training that takes place during work hours should be paid, according to the FLEA. Only in certain instances can train go unpaid. The training takes place outside the worker's normal work hours. The training is not mandatory.
Can a job require unpaid training?
Yes. If you are required to attend a training program for work, you must be paid for that time. For example, if your employer requires all new employees to attend an orientation training or requires current employees to attend sexual harassment training, that time must be paid.
