In a Warranty Deed, consideration is the dollar amount the grantee will pay to the granter in exchange for the interest in the property. For example, $25,000.00. If the property is being given as a gift or transferred without consideration, you will still need to fill out the consideration amount on your Warranty Deed.
Consideration is a legal term used to describe the value that changes hands as part of an agreement between two or more parties. The contract will also require the seller to sign and deliver a deed (usually a Warranty Deed or Special Warranty/Grant/Covenant Deed) as consideration to the buyer.
Consideration — The amount actually paid for something (not necessarily the same as its value). Conveyance — A document which transfers property from one person to another. Estate in Land — The nature of the interest of an owner with regard to his land, which may be fee simple or a leasehold or life estate.
Consideration Certificate. Provides that a statement of consideration be on virtually all deeds. In the case of an exchange of properties, the fair cash value of the property being exchanged shall be stated in the body of the deed.
In contrast with a contract or agreement, there is no requirement for consideration for a deed to be legally binding. A deed does not need consideration because of the idea that a deed is the most solemn indication that the parties intend to be bound.
Consideration in a Quitclaim Deed is what the Grantee will pay to the Granter for the interest in the property. For example, if a Grantee is purchasing a Granter's interest in a property for $10,000, the consideration would be $10,000.
This is something of value is known as consideration, and in our case is whatever it is we are paying you for the property. The first paragraph of our Conveyance states: “in consideration of the sum of Ten and more dollars ($10.00) cash in hand paid and other good and valuable consideration.”
So, the original post in seeing $10 as consideration for a deed with other good and valuable consideration (which is probably $149,990.00 and not just a promise) is an acceptable phrasing used, but that has no bearing on the sufficiency of any consideration paid in a purchase contract.
