Unless an information or indictment is filed or the affected person consents in writing or on the record in open court, an accused shall not be detained in jail or subjected to conditions of release for more than 72 hours after the defendant's detention in jail or release on conditions, whichever occurs first.
Penalties For Failure To Appear You can be charged so long as you made no attempt to appear within 14 days of your court appearance date. The penalty for violating this section is a maximum fine of $1000 and no more than 6-months in the county jail.
Although the sixth amendment to the Constitution guarantees each arrested individual the right to a speedy trial, in most states, a speedy trial is defined as being charged and released on bail within 72 hours. Once the 72-hour period is up, you should be either charged with a crime or released.
Those who are arrested for more serious crimes like murder or domestic violence will have to stay in jail until the bond hearing. Most states can't hold suspects in jail for more than 48 to 72 hours without filing charges against them.
