A seller of real estate uses a deed to convey title or interest in the property to the buyer. Of all deed forms, the quitclaim deed gives the buyer the least amount of protection. Instead of conveying marketable title, the quitclaim deed only conveys the seller's interest in the property to the buyer.
A quitclaim deed can convey title as effectively as a warranty deed if the granter has a good title when the deed is delivered. If the title contains a defect, for example, the grantee has no legal recourse against the granter under the deed.
Quitclaim deeds are most often used to transfer property between family members. Examples include when an owner gets married and wants to add a spouse's name to the title or deed, or when the owners divorce and one spouse's name is removed from the title or deed.
It's an inexpensive way to transfer property, and, while an owner of a property acquired by quitclaim deed can't sell it without a clear title, the property can be sold later after a warranty deed is obtained. You can then buy title insurance and, with legal title, transfer the property through a warranty deed.
To use a Quitclaim Deed to add someone to a property deed or title, you would need to create a Quitclaim Deed and list all the current owners in the granter section. In the grantee section, you would list all the current owners as well as the person you would like to add.
An implied promise in a contract when a seller is selling land to a buyer is that the seller will deliver marketable title to the buyer at the date of the closing. A title to a piece of land is considered unmarketable if there are encumbrances on the land, such as mortgages, unless the buyer waives them.
Marketable title (real estate) is a title that a court of equity considers to be so free from defect that it will legally force its acceptance by a buyer. In the absence of an agreement to the contrary, there is an implied undertaking in the contract that the vendor (person selling the property) has a marketable title.
The property seller must deliver marketable title to the buyer. In everyday language, that means the title must be free of liens, encumbrances, easements or other title defects the buyer is not willing to accept. The best evidence of marketable title is a lender`s or owner`s title insurance policy.
