You CAN fax an unsigned document to your recipient and have him sign the document in front of a notary. The notary can then notarize the document and that will be legally binding. What you CAN'T do is sign the document and then fax it. A document can only be notarized if it has an original signature.
Fax copies can be considered legal documents and are often accepted as such in many agencies and establishments. Thanks to the almost flawless anti-tampering method when it comes to faxing, many businesses will accept a faxed copy of an original document, such a signed contract, as legally binding.
A contract or legal agreement containing a photocopied or faxed signature is deemed valid and enforceable in most states. If a document is a simple contract between parties, a fax is okay to use but an original signed document is better.
A photocopy or fax may be notarized, but only if it bears an original signature. That is, the copy must have been signed with pen and ink. A photocopied or faxed signature may never be notarized. When carbon copies are made, the Notary will sometimes be asked to conform rather than to notarize the copies.

To start, report to your local courthouse and ask for an affidavit form. Affidavit forms are readily available for free at most local courthouses. The forms may be filled out by following simple instructions provided on the form. A form affidavit is not required, however, for a valid affidavit.
If there is no court form of affidavit available for your needs, you can search for affidavit forms either online or at your local county law library. Although these affidavit forms are unofficial, it is appropriate to use such forms when there is no court form specified for use.
