A sublease contains details about the rental arrangement between the sublandlord and subtenant, including whether: The sublease term will be fixed or renew automatically. The entire premises or a portion of the premises will be sublet. Rent and utilities will be the same as under the master lease.
Subletting. Even if your lease forbids it, you have the right under the law to sublease your apartment, and the lease provision is null and void. Rent controlled tenants may, however, sublet if they have a current or prior lease that contains a clause permitting subletting, or if the landlord consents.
Writing Your Sublease. State the name of the parties and the date of the contract. Identify the full names of each party and what their role is in the contract. The original leaseholder of the property is the Tenant and the person subletting the property is the Subtenant.
The subtenant must give a notice of one month in order to terminate the sublease. The subtenant is also required to give reasons for leaving the premises. A sublease can be terminated early if the subtenant is willing to pay the rent until the end of the month and an amount in addition to this.

An unsigned lease may or may not be enforceable, depending on your state's law. Both landlords and renters should sign a lease for legal purposes. And after lease signing, both parties should have a copy, either printed out or saved online.
In California, if the landlord has not signed the lease defaults to month-to-month. You or the landlord can terminate the lease with 30 days notice, unless you have been in the property for more than one year when 60 days notice is required.
Broadly speaking, the lease will be enforceable against the party or parties who signed the lease, even if others did not. It may also provide that it is not valid unless countersigned by the landlord, meaning that even after the tenants sign the landlord may be able to reject the lease.
Whenever you rent a house or apartment, you make a lease. Even if you never sign anything and just give the landlord some money in exchange for the key — you still have a lease. BUT if you don't keep your promise by paying the rent, the landlord can take you to court and evict you.
No need to evict. Having no lease just means that it's a month to month lease and you can terminate that any time you want. If they still do not move out, notify them that you will pursue legal action (an eviction) in 3 days. If they are still not out, then you pursue an eviction just like any other rental agreement.
Bring Proof of Identity. Signing a rental lease is a significant financial decision. Your Social Security Number. Proof of Employment. List of Previous Jobs. List of your Past Addresses. List of References. Check, Money Order or Cashier's Check. Vehicle Registration and Proof of Insurance.

Understand the potential penalties. The landlord tenant laws that allow you to break a lease are different from state to state. Check your lease. Talk to your landlord about breaking a lease. Offer to help find a new tenant. Consider subletting to avoid breaking a lease.
