Possession of crack, in any quantity, is illegal. The use, possession, distribution, sale, and trafficking of crack are crimes that carry different degrees of legal and financial penalties. Felony offenses carry a potential of up to 20 years in prison depending upon the degree of the offense.
If it's possession of less than 25 grams, it's a felony with a maximum penalty of four years in prison. The more grams you have, the higher the potential penalties and there is mandatory minimum prison time if you have a certain amount. If you are dealing, the penalties are even higher and more serious.
Amount of Crack Possessed Any amount of possession above 28 grams is classified as a trafficking offense (rather than possession) and includes mandatory minimum sentences of between three and 15 years in prison, alongside fines of up to $250,000.
However, possession is nonetheless a crime, and even mere possession of small amounts can be charged as a felony in states that have strict drug possession laws. And in those that are more tolerant, when very dangerous drugs are involved, such as heroin or cocaine, felony charges are likely.
If you are convicted of selling or possessing with the intent to sell crack cocaine in California, you could face up to five years in jail. The penalty increases to up to nine years in custody if you cross two or more California counties to sell illegal drugs.
President Obama signed the Fair Sentencing Act of 2010, doing away with the five-year mandatory minimum for possession of five grams of crack cocaine, and increasing the amount of crack required to result in a mandatory sentencing for federal drug trafficking crimes.
