Many people are confused between the Application Filing Date and the Final Action Date. Final Action date: This is the column or chart for what had been the actual priority dates, when a visa could be issued or adjustment of status approved and to calculate a child's age under the Child Status Protection Act (SPA).
The Date for Filing means that the Visa Office of the Department of State will let you file for your adjustment of status somewhat sooner, provided you are eligible within the United States before your priority date is actually reached, which would be your Final Action Date.
Final Action date: This is the column or chart for what had been the actual priority dates, when a visa could be issued or adjustment of status approved and to calculate a child's age under the Child Status Protection Act (SPA).
Any date in any category in the Visa Bulletin indicates the “cut-off date” for a given immigrant visa category. If the priority date is earlier than the cut-off date, it means that the immigrant visa number is available and the beneficiary can file either for adjustment of status or go with consular processing.
You have one year after your priority date becomes current in the Application Final Action Dates chart to pursue your visa or green card. If you do not, the government assumes you have abandoned it, and will give your visa number to the next person in line.
In January 2019, the priority date for worldwide EB-1 will be April 1, 2017, which means you are months away from having a current priority date. However, the worldwide EB-1 date on the Filing Date Chart in January is June 1, 2018.
If the final action date moves forward until it matches the current calendar date, it will be considered current (marked by a C in the bulletin). If your category is current, then you can move forward with adjusting your status or consular processing as soon as your petition has been approved.
What to Do When Your Priority Date Is Current. One day, your priority date will become current in other words, you will finally see a later date, or the letter C on the Dates for Filing Visa Bulletin chart. Then it's time to move forward with the process of getting your immigrant visa or green card.
To see what priority dates are becoming “current” (meaning that people with those dates are now becoming eligible for visas/green cards), you should check the Visa Bulletin published by the U.S. State Department every month. It shows a list of visa cutoff dates, in every category.
