Simply put, yes, digital signatures are valid and enforceable. As long as certain requirements are met, they have the same legal effect as their written equivalents. Like a traditionally signed contract, one of the most important elements of validity is the signing party's intent to be bound.

The requisite elements that must be established to demonstrate the formation of a legally binding contract are (1) offer; (2) acceptance; (3) consideration; (4) mutuality of obligation; (5) competency and capacity; and, in certain circumstances, (6) a written instrument.
The agreement must be real and not be based on one party's deceiving another, on an important mistake, or on the use of unfair pressure exerted to obtain the offer or acceptance. What the parties agree to must be legal. An agreement to commit a crime or tort cannot be a legally enforceable contract.

The elements of a legal contract are that there must be an offer made by one party and accepted by the other, mutual consideration and a willingness to enter into a binding agreement.
