Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
The general answer is YES. Most jurisdictions will permit photo copies, whether they be from a copy machine or fax. To have a document admitted into evidence you need to be able to establish that it is bona fide and that the party to be charged agreed to the document. Agreement can manifest itself in different ways.
For important employment records such as employment contracts, stock agreements, and general release sit remains best practice to retain complete original signed documents. However, original signatures, including notarized documents, are not as legally significant as they once were.
Each party should get an original signed copy of the contract for their files. That means if there are two parties to the contract, two identical contracts must be signed. One original copy of the contract should go to you, and one original copy should go to the other party.
Are Fax Copies of Signed Documents Legally Enforceable and Acceptable? ... If the only reason for the creation of the document is for contract enforcement, then a faxed or emailed copy is acceptable. A contract or legal agreement containing a photocopied or faxed signature is deemed valid and enforceable in most states.
The term “counterpart” is used in legal documents to describe a copy of a contract which is signed and is considered legally binding, in the same way as the original. In many cases, several copies of a contract document are prepared, so that all parties and signatories can have a copy of the contract.

It's valid because both parties signed, not because both (or all) parties have a copy of it. ... One exception, as I mentioned above, is if the document or related law requires that signed copies be provided to all parties.
A contract is basically an agreement to do or not to do something. Saying a contract is valid means it's legally binding and enforceable. ... Either way, a contract must include the following: parties capable of contracting, consent of the parties, a lawful object, and consideration. Parties.
A faxed copy of a document is not the original and, obviously, neither is a copy of an original document. ... In other words, is a contract still legally binding if the only signatures on record are faxed copies? The short answer is that it depends.
It depends on who has scanned the entry. If the scan has been done by a Registry Office and then authenticated with a Registrar's signature or an official seal; then it can be considered as an original copy. It can be used as evidence of the event recorded.
