Likewise, even if a matter has been decided and an appeal has been noted, it does not preclude the party from continuing in settlement negotiations. Typically, an appeal will take a year to 18 months from the time it is initiated until the time the court of appeals renders a decision.
Next, the Court of Appeals may take six months or longer to decide whether there will be oral argument in the case. The Court usually decides cases within two to six months after oral argument, but there is no deadline. If the Supreme Court reviews your case, your appeal of course will take more time.
Once the appeals court takes the case to make a decision, it normally takes about a month for it to render an opinion. That puts us at about eighteen months from trial decision to appeals decision, with no real detours along the way.
The judges have 90 days from the date the case is submitted to decide the appeal. The clerk of the court will mail you a notice of that decision. The appellate court's decision will become final in 30 days unless any of the parties disagrees with the opinion and files a certain kind of petition.
