No, It's Not Illegal to Throw Away the American Flag Unless it's heavily soiled or damaged, you should keep it. The only time you should dispose of your American flag is when it's heavily soiled or damaged. In instances such as these, the American flag is no longer in a condition to display.
Flag disposal locations such as your local Veterans of Foreign Wars (VFW) posts, American Legion, and scout organizations will gladly take them to recycle or burn. VFW flag disposal locations offer these services to ensure the flags get thrown away properly if others do not have the means to.
If you don't want to have your own ceremony, but still want to ensure that your flag will be properly retired, you can bring it to a flag retirement location, such as a VFW or American Legion, or others in your community. You can also send your flag in to be recycled.

To recycle a flag, simply write “Recycle” on the header of the flag before handing it over to your local Post or scout troop. The nylon will be reused in making new American flags. If nylon flags are not recycled, it is customary to cut the union from the field and dispose of the flag with the proper ceremony.
Many American Legion posts conduct disposal ceremonies of unserviceable flags, especially on Flag Day (June 14). Take your old flags to your local American Legion post. They will be happy to retire your flags in their next disposal ceremony.
The United States Flag Code (4 USC Sec 8 Para (k) Amended 7 July 1976) states: “The Flag, when it is in such condition that it is no longer a fitting emblem of display, should be destroyed in a dignified way, preferably by burning.” Burning isn't the only way to dispose of a flag, though.
