A Great Source for Reference As soon as I came across PDFFiller I immediately subscribed. This one-year correction period has become known in the construction industry as a one-year warranty. Both owners and contractors point to this provision as a contractual limit on the contractor's obligation to correct defective work discovered more than one year after completion of the construction.
These also vary by state. In California, the statute of repose is four years for most defects, but 10 years for latent defects (those that aren't observable right away, such as a faulty foundation). In Georgia, the statute of repose is eight years for all claims related to design or construction of the building.
This warranty extends for four years after the completion of a job. Finally, under California law, both the contractor and engineer who signs off on a project must provide a ten-year warranty against structural defects, including latent defects such as unstable building sites, foundation integrity, and roofing work.
Most, if not all, construction contracts contain warranties. A warranty that work will be performed in a good and workmanlike manner. A warranty that materials will be new and of good quality. And. A warranty that the work will conform to the requirements of the contract documents.
Unless you specifically spell out a different time period in a contract, Utah law permits contract and warranty claims to be filed within six years of the date of completion (or abandonment) of the improvement.
