The WARN act applies to your organization if you have over 100 full-time employees. The WARN act applies to all publicly and privately held companies. The WARN act applies to all organizations that are for profit or not for profit. A WARN notice must be given if there is a plant closing or a mass layoff.
The WARN Act Requires Employers to Give 60 Days Notice The WARN Act requires that the employer provide 60 days of written notice of the intention to lay off more than 50 employees during any 30-day period as part of a plant closing.
WARN Act Severance If an employer does not give advanced notice of a plant closure or mass layoff, sometimes it will pay workers a severance of 2 months' pay. The WARN Act may require not just two months of pay, but also compensation for two months' worth of benefits (such as the cost of health insurance).
California's WARN Act defines a mass layoff as a layoff of 50 or more employees in a 30-day period. The California WARN Act also covers workers who suffer a layoff due to a business stopping or suspending its operations or relocating to a location more than 100 miles away.
