The first steps in the appeal process: The notice of appeal and the Board's response.
Appeals at a Glance: An appeal is a review of the trial court's application of the law. There is no jury in an appeal, nor do the lawyers present witnesses or, typically, other forms of evidence. Another difference between a trial and an appeal is the number of judges involved. A single judge presides over a trial.

In law, an appeal is the process in which cases are reviewed, where parties request a formal change to an official decision. Appeals function both as a process for error correction as well as a process of clarifying and interpreting law.
What happens at an appeal hearing? Appeals against conviction are determined by using the evidence given at the lower court, that is, the district court reviews the transcript. An appellant is entitled to one free copy of the transcript of the lower court hearing. Apply for a transcript directly to the lower court.
If the Judge allows your appeal, his or her determination will be sent to the relevant visa section, which will in turn contact you. It can take up to 4 weeks for determinations to reach the relevant visa section, and a further 8 weeks for them to be processed.

Generally, the losing party in a lawsuit may appeal their case to a higher court. The higher court then reviews the case for legal errors. If an appeal is granted, the lower court's decision may be reversed in whole or in part. If an appeal is denied, the lower court's decision stands.
