Physicians are not required to provide patients directly with a copy of their medical records. Unless otherwise limited by law, a patient is entitled to a copy of his or her medical record and a physician may not refuse to provide the record directly to the patient in favor of forwarding to another provider.
When a person changes their doctor it is standard practice for the medical record to be transferred to the new doctor. That being said it would be reasonable to request that your former doctor send your original medical record to your new doctor, assuming that the record still exists.
Let your new doctor know that you haven't been able to obtain your medical records. Request a copy of the claims that have been submitted on your behalf from your health insurance company. Contact hospitals in your area that you believe might have access to your medical records. Contact MAG.
To obtain access to your medical or health records from public health facilities, you will need to contact the relevant Local Health District. A fact sheet about accessing your medical or health records from public health facilities, such as NSW hospitals, is available from the NSW Information and Privacy Commission.
Fill out an authorization form giving one medical provider permission to share your records with another. Mark on that form which types of records you want included. Pay any fees that result.
A growing number of healthcare facilities offer their authorization forms online, so they can be completed ahead of time. Some facilities allow patients to mail or e-mail the form if requesting certain record services, such as transferring records to another provider or payer covered by HIPAA.
Generally, medical records are kept anywhere from five to ten years after a patient's latest treatment, discharge or death.
Know your rights. Find out if your care provider offers Blue Button. Inspect but don't obtain your records. Get electronic copies of your records. Ask your current doctor to obtain your records for you.
Call your doctor's office and ask for a copy of your medical records. Some doctor's offices keep your files in archive, failing to throw out old files for years and years. You may be one of the lucky few who will still have access to these records. Contact your local health department.
Record requests can be honored without a patient's signature. However, most state laws require record requests to be in writing and signed by the patient. I recommend you always obtain a signed, written release in a nonemergency situation, whether required by law or not.
HIPAA not only allows your doctor to give a copy of your medical records directly to you, it requires it. In most cases, the copy must be provided to you within 30 days. That time frame can be extended another 30 days, but you must be given a reason for the delay.
Is it Illegal to Alter Medical Records? Altering a medical record is a crime and can also be used against doctors in medical malpractice cases. However, it is not illegal for medical professionals to make honest updates to records, as long as they properly mark what they are doing and do not obscure information.
