California Labor Code Section 226(a) outlines nine specific items that must be included on a pay statement: The pay period beginning and end dates. The employee's name and only the last four digits of his or her Social Security number (or an employee identification number other than a Social Security number).
Employers in California are required to provide employees with an itemized wage statement, also known as a pay stub. Employers are required to provide pay stubs semi-monthly or at the time of each payment of wages. Pay stubs are required even if an employee is paid in cash.
Although federal labor law does not require employers to provide pay stubs to employees, California pay stub law requires employers give an itemized wage statement or pay stub for each pay period (a standard pay period is 2 weeks).
You can obtain a copy of your pay stubs by contacting your employer's human resources or payroll department. Some employers might require employees to submit a formal request to get copies of pay stubs, while others maintain employee pay information in an online database.
In California, an employer may not withhold or deduction wages from an employees' paycheck, unless: required or empowered to do so by state or federal law, a deduction to cover health, welfare, or pension contributions is expressly authorized by a wage or collective bargaining agreement.
Employees who quit must receive their final paycheck within 72 hours of giving notice that they're leaving. Employees who are fired must be paid on the same day as termination. California final paycheck laws require that the final paycheck include all wages and business expenses that the employee is owed.
California law says that an “employee who quits must be paid at the office or agency of the employer in the county where the employee worked.” In some circumstances, however, employees who quit can request that their paycheck be delivered by mail or direct deposit.
Can an Employer Pay Me Late in California? The simple answer is no. California labor laws require most workers to be paid a minimum of twice per month. If your employer makes you wait for a paycheck, the employer may be subject to instituted penalties that you'll be entitled to collect.
