Can an employee work with a tentative nonconfirmation?

An SSA or DHS Tentative Nonconfirmation (TNC) results when the information entered in E-Verify does not match SSA records or data available to DHS. A TNC does not necessarily mean that the employee is not authorized to work in the United States.

A Tentative Nonconfirmation (TNC) is received when either the Department of Homeland Security (DHS) or Social Security Administration (SSA) flags something entered on the I-9 as not matching their records. A “DHS TNC” or “SSA TNC” case result may occur because the employee's.

Generally, if the information matches, the employee's case receives an Employment Authorized result in E-Verify. If the employee does not contest the TNC, or if the query ultimately results in a Final Nonconfirmation, you must terminate the worker's employment or face possible fines and penalties for knowingly continuing to employ an unauthorized worker.
