Can a settlement offer be rescinded?
Once the parties reach a settlement agreement, it becomes a binding contract, which can only be rescinded for limited reasons, such as fraud by one of the parties. However, a settlement offer is just that -- an offer. An offer does not become a binding contract until the other side accepts it.
Can a judge overturn a settlement agreement?
Once the paperwork has been signed, there is a limited amount of time to rescind the settlement agreement before the judge finalizes it. Usually, an attorney will need to file a motion immediately, and present an argument to the court about why the agreement should be rescinded.
