All sound recordings created after January 1, 1978, are automatically protected by copyright. A sound recording is considered created when it is fixed in a foreword for the first time. Neither registration in the Copyright Office nor publication is required for protection under the present law.
Copyright in sound recordings made before 1 May 1969 lasted until 50 years from the end of the year the recording was made. Films made before 1 May 1969 were protected as a combination of photographs, dramatic works and sound recordings.
Similarly, copyright in sound recordings expires 50 years from the end of the year in which the recording was made, unless the recording is published during that 50-year period in which case the copyright will expire 70 years from the end of the year in which it was published.
Copyright in sound recordings is generally owned by the 'maker' of the sound recording. The term 'maker' usually refers to the person who owns the equipment the recording was made on, such as the production company, studio, or record label.
These can be split into: producers' rights (usually those of the record company) and performers' rights (those of the performers that feature on the recording). Although they may transfer control of these rights to the record company, by law they will retain some economic rights in their performances.
