According to Penal Code 1203.4 PC, expungement releases the defendant from all penalties and disabilities incurred by the conviction. Although, in California, a criminal record cannot be fully erased from public view, expungement will alter your record to read dismissed in the interests of justice.
Most first time offenders can have a felony expunged or sealed, but your chances of this happening are much greater or will happen if you have: Completed all court orders including but not limited to. Prison sentence, probation, fines or reparations. You're not a repeat offender.
California law allows people who were arrested but never convicted to have their California arrest records sealed and destroyed as a matter of right (automatically). Sealing an arrest means the record will not show up on most criminal background checks in California, other than to law enforcement.
Unfortunately a felony doesn't ever go away unless you go through a strict process to have it expunged.
Typical costs: Hiring an attorney to handle an expungement starts around $400-$1,000 for a single criminal charge but can run $1,000-$4,000 or more depending on the number and nature (misdemeanor or felony) of the charges, prevailing local legal rates and the status and experience of the attorney.
Since the timing of the process varies from state to state and by case, a general estimate of the time it takes to have a criminal record expunged can be anywhere from 2-6 months.
Is there a deadline for moving to seal my California arrest record? Under prior California Penal Code 851.8 people had just two years from the latter of their arrest or the filing of charges to petition to seal their arrest record.
While you may truthfully testify under oath that you have never been convicted of a crime when your record has in fact been expunged, the government still maintains evidence of your conviction and may use it against you in the narrow and specific circumstances allowed by state law, such as the situations described
