Option One Apply To Court To Change The Court Hearing Date This requires a court form to be sent to the court with a court fee. The court is more likely to move it if you both agree. You will need a good reason to move it as generally, the courts don't like having to move a court hearing date.
File a motion to change your trial date (adjournment) and supporting affidavit must be completed and filed at least 5 days prior to your scheduled court date, or. You can send someone over the age of 16 to your trial date to explain why you can't attend.
Fill out Request to Postpone Trial (Small Claims) (Form SC-150) OR write a letter to the court explaining why you need to change your court date. Make a copy of your Request or letter for yourself and one for each other party in the case.
Reschedule your court date. If you can't be in court on your scheduled court date, contact the duty counsel office well in advance of your court date. They may be able to help reschedule your appearance for an earlier date. You will need to go to the Crown's office and get permission to reschedule the court date.
If you need to postpone a court date, call or visit the clerk's office of the court handling your case as soon as possible and explain why you can't attend the scheduled date. If the clerk considers your grounds reasonable, they will tell you which forms or motions you need to file with the court.
