Congress first addressed the issue of junk faxes in the Telephone Consumer Protection Act of 1991 (CPA). A recipient can terminate the EBR exemption by opting-out of future fax advertisements. The FCC stated that an opt-out request should be honored even if the sender continues to do business with the recipient.
