Employment certificates (example) include the minor's age and proof of eligibility to work. An age certificate provides documentation that the minor meets the minimum age requirements to be hired. Documentation requirements for the employment of minors are established by each state's department of labor.
The Department of Labor will issue age certificates if the minor employee's state does not issue them, or if the minor is requested by his or her employer to provide one. However, the vast majority of age certificates are issued by states.
Why are employment and age certificates typically required? They protect employers from hiring someone that is too young. They indicate the minor has the proper training to work.
Typically, after an employer agrees to hire a minor, the minor obtains from his or her school a Department of Education form entitled “Statement of Intent to Employ Minor and Request for Work Permit”. The form must be completed by the minor and the employer and signed by the minor's parent or guardian and the employer.
Why are employment and age certificates typically required? They protect employers from hiring someone that is too young. For what reason may an employer legally NOT hire an applicant? The applicant is not able to do the job or meet the hours required by the job.
The purpose of these certificates is to protect the employer from prosecution for employing an under-aged worker. The possession of an age certificate constitutes a good faith effort to comply with minimum age requirements. Some states require work permits or age certificates for young workers.
The rules vary depending upon the particular age of the minor and the particular job involved. As a general rule, the FLEA sets 14 years old as the minimum age for employment, and limits the number of hours worked by minors under the age of 16.
