The simple answer is that text messaging is HIPAA-compliant under certain circumstances and provided that administrative, physical and technical safeguards [exist] to ensure the confidentiality, integrity, and security of electronically stored or transmitted private health information.
There is nothing wrong per se with physicians using text messages to communicate with other healthcare professionals and care teams. However, SMS texting is a violation of HIPAA Rules if the text messages contain any protected health information for which a patient had not given their consent.
The HIPAA regulations for SMS do not specifically prohibit the use of a Short Message Service to communicate Protected Health Information (PHI), but they do stipulate that certain conditions have to be in place before using SMS to communicate PHI is HIPAA-compliant. Most SMS messages are not HIPAA-compliant.
Although text messaging can be fast and easy, the most common format of texting, short message service (SMS) is not sufficiently secure for a health care environment. SMS text messages, which are sent and stored on servers in plain text, can be intercepted during transit.
iMessage is a built-in instant messaging (IM) service offered by Apple for all its devices. There are a number of HIPAA-compliant messaging and data storage apps that have long been popular with iPhone and Mac users in the health care field, but Apple's iMessage messaging service remains unsecure and non-compliant.
SMS stands for Short Message Service and is also commonly referred to as a “text message”. With an SMS, you can send a message of up to 160 characters to another device. Longer messages will automatically be split up into several parts. Most cell phones support this type of text messaging.
While HIPAA does not specifically prohibit sending PHI by text, in order for texting to be HIPAA-compliant, texting safeguards have to be in place to ensure the confidentiality of PHI when it is at rest and in transit.
