What Is a Confession of Judgment? A confession of judgement is a written agreement, signed by the defendant, that accepts the liability and amount of damages that was agreed on. A confession of judgement is a way to circumvent normal court proceedings and avoid a lengthy legal process to resolve a dispute.
California's Code of Civil Procedure sets forth the law governing confession of judgement procedures at CD 1132 1134. Specifically, §1132(b) states: 1132. Still others hold it illegal, making void any agreement to confess judgement that is entered into prior to commencement of an action.
A confession of judgement (COM) in New York is a way for a party to obtain a judgement without the need to bring a lawsuit. It is a document in the form of an affidavit by the party confessing judgement. Both individuals and entities (i.e., such as corporations and LCS) can confess judgement.
A confession of judgement is a pleading filed in the Court of Common Pleas of Pennsylvania that gives the Plaintiff an immediate judgement against the Defendant without prior notice and an opportunity to be heard in court by the Defendant.
Confessions of judgement are often used in conjunction with settlement agreements or as part of transactional documents in New York. Effective as of August 30, 2019, confessions of judgement executed after that date by parties that reside outside of New York are no longer enforceable.
That judgement can be enforced against any property you have that can be assigned or transferred (such as money, bank accounts and real property). The judgement also stays on your credit report for up to 10 years, which is three (3) years longer than other debts.
