Blown away. EZ to use once figured out, and quite intuitive. Only a couple surprises where the DOS commands didn't always work e.g. cut and paste. The shift/delete cut worked, but the shift/insert paste didn't. Just need a little time to find my groove. All I can say right now is: Bye, Bye handwritten forms. dc macdonald

With some exceptions, separating parties must commence proceedings for a Property Settlement (bring a Court Application) within twelve months of their Divorce, for a married couple and for a defect couple, within two years of their separation.
So long as the agreement was properly drafted & doesn't contain provisions against public policy, then the Judge has no authority to change any provisions. The Judge may review it merely to understand what the settlement is, but that's
Yes. Said differently, upon the filing of a motion, the Court can set aside a Mediation Agreement. The most common reason would be fraud or duress.
A settlement is a contract between the parties to a lawsuit that ends the case without a trial. Once the parties reach a settlement agreement, it becomes a binding contract, which can only be rescinded for limited reasons, such as fraud by one of the parties. However, a settlement offer is just that -- an offer.
Changes Before A Settlement Is Finalized Usually, two people enter into a divorce settlement after attending a mediation, or after negotiations between their attorneys. However, it is easier to rescind a divorce agreement before it is entered into the divorce decree than it is to change it afterward.
Generally, it should take a week or two to get the settlement agreement to your attorney from the other side. When everyone has signed, your settlement must be approved by a Workers' Compensation judge, which can take up to two weeks. Once it is approved, an insurance company has up to 30 days to mail your check.
In a legal separation proceeding, a court can decide matters such as child custody and support, alimony and property division. However, as stated above, the spouses will remain legally married and cannot remarry unless and until they get a divorce. Whether one spouse is entitled to temporary alimony.
On the other hand, being legally separated in California will allow you to file your taxes as either married filing jointly (both spouses must agree to file this way) or married filing separately. Regardless of where you reside, you must claim the same filing status on both your state and federal tax returns.
