A: No. The employee is not required to disclose the nature of the employee's medical condition or disability (i.e., their diagnosis). The employer cannot ask for the employee's complete medical records as those records may be unrelated to the need for accommodation.
No federal law prohibits employers from asking employees why they are out sick. They are free to ask questions such as when you expect to return to work. They may also require you to furnish proof of your illness, such as a note from a physician.
HIPAA prohibits employers from accessing patient records or insurance claims because it could result in discrimination. If an employer wants to see any of your medical information, the employer would need to receive your written permission.
However, your employer cannot obtain information about you from your health care provider directly without your authorization, unless other laws require them to disclose it. However, if you work for a health plan or a covered health care provider, the Privacy Rule does not apply to your employment records.
Employers have the right to ask for a note from the physician when an employee takes time off for sickness, but they must apply the policy equally to all employees. An employer can require employees to turn in a doctor's note when they are off for more than three consecutive days and cite sickness as the reason.
Can I find out who has accessed my health records? Yes, for the most part. A listing of disclosures of your health information is required by HIPAA. You can find out who has accessed your health records for the prior six years, although there are several exceptions to the disclosure requirement.

You may have to write or email the CPS and request copies of the records the agency has regarding you and your children. In some states, such as Texas and Utah, you'll need to fill out a form requesting copies of your records.
Speaking of the federal government, another organization that may have access to your medical records is the Federal Bureau of Investigation (FBI). Under the Patriot Act, the FBI can get a warrant to secure your medical records during the course of an investigation to protect against international terrorism.
Does my employer have access to my medical records or insurance claims? A. Absolutely not. Under HIPAA, your supervisor or human resource officials can request a doctor's note or information about your health only if needed to administer sick leave, workers' compensation, wellness programs or health insurance.
Under the Personal Health Information Protection Act, you have the right to request access to your own personal health information held by health care providers, called health information custodians, such as doctors, nurses and dentists, and others involved in the delivery of health care services, including pharmacies,
FER PA, the Family Educational Rights and Privacy Act, applies to most school health records most of the time. HIPAA, the Health Information Portability and Accountability Act, applies to some school health records some time. No privacy law applies to some private school health records some time.
Although not required by HIPAA, a policy should be in place to record privacy complaints, investigations and resolutions. This will be of significant benefit to the company and the HR department in particular- if an employee pursues their complaint to the Department of Health & Human Services.
