An arrest warrant is a warrant granted by a judge in a court of law to a law enforcement official granting that law enforcement official the right and ability to arrest a person of interest regarding a crime. Arrest warrants are most commonly required when a crime is committed out of view of a police officer.
To obtain a warrant, a police officer typically submits a written affidavit to a judge or magistrate. The affidavit, given under oath, must recite sufficient factual information to establish probable cause that a crime was committed and that the person named in the warrant committed it.
Three types of warrants are issued in California including a search warrant, arrest warrant, and bench warrant. All types of warrants require probable cause before they can be issued. If an arrest warrant is issued for a serious crime, law enforcement will actively search for the person.
An arrest warrant typically results from a police officer or other member of law enforcement receiving information, or “tips," regarding criminal activity. They may also have observed criminal behavior directly, or discovered information through the investigation of a crime that led to you.
A warrant for your arrest means a law enforcement officer has the right to take you into custody wherever you are. The court may not call you to notify you of the warrant, but you can go online to find out if you may have an outstanding warrant. You can also contact the court clerk, who can provide that information.
Call the sheriff's department and ask to speak with someone in the warrant department, or ask for the phone number to the warrant line. If you haven't had any luck online you may have to resort to a phone call. Some sheriff's departments have a dedicated line for warrants and others do not so make sure to ask.
You either need to go to the court that issued the warrant and self-surrender, or go to police and self surrender. Until you appear before a judge, the warrant will remain active. If you go to the police first, they will arrest you and take you to court within 24 hours of your arrest.
A magistrate issues an arrest warrant after law enforcement provides probable cause to show that the subject of the warrant has committed a crime and should be arrested for it. Its primary function is to protect a person from being unreasonably seized.
Unlike a bench warrant, if a search warrant has been issued against you and the nature of the crime is violent or otherwise serious, the police will actively search for you. You can and will be arrested wherever you are found and taken to jail until you can be arraigned by a judge.
The claim that warrants are usually executed within 48 hours is simply not true, at least in the US. While felony arrest warrants may be the archetype, bench warrants for the arrest of persons failing to appear on citations are nearly certainly more numerous.
Can the police serve a search warrant on Saturday and Sunday? Unless there is an exception in the warrant, it may be served any time the law allows.
Arrest warrants can usually allow a law enforcement officer to enter a residence to arrest a suspect believed to have committed a felony or a misdemeanor. Arrest warrants may result after a person is suspected of a misdemeanor and fails to appear as required in criminal court.
The court clerk will tell you if a bench warrant has been issued against you. If it has, ask the clerk to send the file to the judge who issued the warrant. Then go to that department and apologize to the judge for missing your court date. You can tell him it was a calendaring error.
The police can also enter your home without a warrant or permission if they are in “hot pursuit" of someone whom they have the authority to arrest.
