For pdfFiller’s FAQs

Below is a list of the most common customer questions. If you can’t find an answer to your question, please don’t hesitate to reach out to us.
Breaking the lease might result in the loss of a security deposit. As explained previously, your roommate's misconduct can also be imputed to you, meaning that moving out before the lease expires, causing damage to the unit or not paying rent can cause you to lose your security deposit.
Technically, one covenant's leaving is a breach of the lease, and could provide the landlord with grounds to terminate the entire tenancy. Moving out without the landlord's permission is a violation of a lease clause, and one covenant's lease-breaking is a transgression for which all tenants are liable.
When one person leaves a rental unit midway through the lease, it can put the other people on the lease in a bind. Because a lease is a written contract, the landlord can enforce it in court to get the remaining balance owed on the rental unit.
You both signed a lease, which means that each of you is responsible for paying the entire rent. ... However, it does not mean that your roommate can demand that you terminate the lease. Just as you have agreed to pay that rent, your roommate has as well. You could find someone else to sublet.
Unfortunately, if you're a renter, you can't remove someone's name from your lease. That means if your roommate or ex wants to stay, or keep coming back periodically, and leave their belongings, there's nothing you can do. Your landlord is under no obligation to remove your roommate's name from the lease.
If your joint tenants and you both want to leave, either you or your ex-partner can end the tenancy by giving notice — usually 28 days. You'll both need to move out. If one of you plans to stay, it's usually best to explain this to your landlord or housing association and ask them to update the tenancy agreement.
Landlords have the legal right to evict tenants when someone breaks the lease, which your roommate did if she left before the lease was up. If you're a valued tenant, the landlord isn't likely to bother with an eviction. If you've caused trouble in the past though, he may seize the opportunity to part ways with you.

If your roommate gives you any kind of notice that he or she is leaving in mid-lease, then you may want to get him or her to sign an agreement stating that the departing roommate will: Pay the remaining rent and utilities. The amount of the rent will be depended on the terms of your lease.
Yes, you may sue your roommate. Likely this will be in the County small claims court. Whether the Judge awards you all that you claim or part or nothing is up to the Judge.
