During a strike, most, if not all, non-union teachers stay home and do not report for work on the strike day. It is also not required that non-union members inform their administration of their non-union status, their participation, or non-participation, in the strike.
Answer: In many states, strikes by public employees are illegal. If that is true in your state, then you may have to work during a strike to avoid possible penalties for violating the law. If you want to work during a strike, you must be certain that you are not a union member if you wish to avoid union discipline.
The Union constitution provides for fines and/or assessments to be levied against any union member that either crosses the picket line or refuses to take part in strike activities. Crossing the picket line or failure to participate in the strike will result in loss of union seniority.
At its most basic level, a strike occurs when all the workers in the union stop coming to work. With no workers, the business shuts down. The employer stops making money, though it is still spending money on taxes, rent, electricity and maintenance. The longer the strike lasts, the more money the employer loses.
As a union member, you are bound by the union's constitution and bylaws, which in most unions provide that members who work during a lawfully-called strike can be fined. Such fines can be expensive and may be collectable in state court.
Generally, you cannot use sick leave or vacation while on strike. If you have scheduled your vacation or surgery prior to the strike vote, management will generally honor those requests. If you are ill on a strike day, management will usually require a doctor's note as verification.
Employees who strike risk dismissal, unless it is an official strike (one called or endorsed by their union) in which case they are protected from unlawful dismissal, and cannot be fired for at least 12 weeks.
For parties with a collective agreement, no legal strike may occur unless the vote is held 30 days or less before the agreement expires or at any time after the agreement expires.
