The right of workers to withhold their labor to strike is among the most important of human rights. No society can truly claim to respect liberty and deny workers the right to strike. International law recognizes the right to strike as a fundamental human right.
The right to strike is protected by the National Labor Relations Act (NRA), but not all strikes are legal. Whether a strike is lawful depends on the purpose of the strike, whether the collective bargaining agreement includes a no-strike clause, and the conduct of the strikers.
The right to strike has in effect become customary international law. The right to strike is also an intrinsic corollary of the fundamental right of freedom of association. Moreover, protecting the right to strike is not simply about States fulfilling their legal obligations.
Illegal Strike Law and Legal Definition. Illegal Strike is a strike that is called in violation of law. An illegal strike ignores cooling-off period restrictions or an absolute statutory ban. Such strike is entered without regard to the no-strike agreement of the union.
Striker misconduct is an unlawful strike action. Strikers who engage in misconduct, such as blocking the employer's entrance and threatening violence to those who try to enter, may not be entitled to reinstatement.
An Unfair Labor Practice (UP) is when a public employer violates state labor laws, which UC did by engaging in intimidation tactics, retaliating against workers, and interfering with workers' rights, among other things. Sometimes, the only thing that will get the employer's attention is a UP strike.
Examples include: Refusing to process a grievance because an employee is not a union member. Threatening an employee for filing a UP charge. Refusing to negotiate in good faith with an agency.
Lawful Purposes A strike is legal and therefore protected by the NRA if the employees are striking for economic reasons or to protest an unfair labor practice by the employer.
