New Form I-9 Released On Jan. 31, 2020, USCIS published the Form I-9 Federal Register notice announcing a new version of Form I-9, Employment Eligibility Verification, that the Office of Management and Budget approved on Oct. 21, 2019. This new version contains minor changes to the form and its instructions.
There are no official laws that require employers to verify employment on former employees. However, the U.S. Equal Employment Opportunity Commission stipulates that it's illegal to refuse to provide information based on race, sex, color and other non-job-related factors.
Because most employers will verify your employment history to one degree or another before finalizing a job offer. Organizations can also call former employers and share the information supplied in your resume, or job application, and ask previous employers to confirm its accuracy.

The Immigration Reform and Control Act (IRA) of 1986 requires all U.S. employers, regardless of size, to complete a Form I-9 upon hiring a new employee to work in the United States. The federal government uses E-Verify to enhance enforcement of federal immigration law.
Employer Review and Attestation. Employers must complete and sign Section 2 of Form I-9, Employment Eligibility Verification, within 3 business days of the date of hire of their employee (the hire date means the first day of work for pay).
Employers use Employment Eligibility Verification to confirm the identity of a new employee and verify he or she is eligible to be employed in the US. All employers do this by completing Form I-9. Many also electronically verify eligibility with DHS and SSA through E-Verify.
E-Verify is an Internet-based system that compares information entered by an employer from an employee's Form I-9, Employment Eligibility Verification, to records available to the U.S. Department of Homeland Security and the Social Security Administration to confirm employment eligibility.
ABOUT E-Verify. E-Verify, authorized by Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (INDIRA), is a web-based system through which employers electronically confirm the employment eligibility of their employees. E-Verify is administered by SSA and U.S. Citizenship and Immigration Services (USCIS).
Employers who participate in E-Verify must: Follow E-Verify procedures for each employee for whom an E-Verify case is created. Notify each job applicant of E-Verify participation by clearly displaying the Notice of E-Verify Participation and the Right to Work posters in English and Spanish.
A case result of Verification in Process means that DHS cannot verify the data and needs more time. The case is automatically referred for further verification. DHS will respond to most of these cases within 24 hours, although some responses may take up to 3 federal government working days.
Unless an employer is a federal contractor with a federal contract containing the FAR E-Verify clause, it cannot use E-Verify for existing employees. Employers should not go back and create a case for any employee hired during the time its account was inactive and there was deliberate non-use of E-Verify.
You may not use the I-9 form as part of the applicant screening process or background check; If the new hire does not present acceptable identification documents by the end of three business days after the first day of work for pay, you may terminate the employee for failing to complete the I-9 form.
Failing to timely complete an I-9 for employee or doing a awful job of it can result in fines of $110 to over $1000 per employee for the first infraction. These fines impact large and small business alike.
