The reportable quantities of a hazardous substance is the amount of that substance that has to be released before the EPA requires notification to go to the National Response Center. These quantities are based on volume. For example, if even one pound of arsenic pentoxide is released, it is reportable to the EPA.
For each CER CLA hazardous substance, EPA establishes a reportable quantity (RQ). When an RQ or more of a hazardous substance is released into the environment, the person in charge of the facility or vessel from which the release occurs must immediately report it to the National Response Center (NRC) under CER CLA.
Definition. Reportable Quantity (RQ) the quantity of a hazardous substance that triggers reports under the Comprehensive Environmental Response, Compensation, and Liability Act (CER CLA).
Spills that have polluted water can be reportable if the spill is a hazardous substance listed in 40 CFR 117 that meets or exceeds its RQ OR an oil spill that has: The list of CWA hazardous substances has been incorporated into the CER CLA list. Therefore, a spill falling under the CWA is also reportable under CER CLA.
Gasoline: 75,000 gallons or more Diesel Fuel: 100,000 gallons or more This RQ is only for gasoline stored in underground storage tanks (MUST) that are in compliance with all Department of Environmental Quality (DEQ) regulations.
Benzene (CAS number 71-43-2) is a CER CLA hazardous substance listed in the List of Lists. The reportable quantity (RQ) for benzene under CER CLA is 10 pounds.
Jurisdiction. Any release that exceeds 25 gallons must be reported within 24 hours of discovery. A release less than 25 gallons that is not contained and cleaned up within 24 hours must be reported immediately. Any suspected leak must be reported within 24 hours of discovery.
