Power of attorney is when you voluntarily assign someone the right to make legally binding decisions on your behalf. A conservatorship is when the court assigns someone the right to make those decisions for you.
A Guardianship is the appointment of a person to make decisions for a minor child. A Guardianship is available for individuals younger than 18, and a Conservatorship is for the purpose of adults over the age of 18.
Conservatorship must be court-ordered and is based on medical proof, such as physical or psychological evaluations, as well as lay witness testimony describing the individual's inability to care for him or herself. Any interested party (not just a relative) can petition the court for conservatorship.
The person who believes another needs a conservator must file a petition with the court in the county where the ward lives. The petition must include a report by a doctor, psychologist, or senior psychological examiner that explains the proposed ward's medical condition.
In Tennessee, the Court may appoint an Emergency Conservator without notice if substantial harm is imminent. The Ward or Conservatee must be given notice of the appointment within 48 hours and a hearing must be held within 5 days. The Emergency Conservator may only serve for a maximum of 60 days.
Conservatorship is defined in Tennessee Code Annotated 34-1-101(4)(A): “Conservatorship is a proceeding in which a court removes the decision-making powers and duties, in whole or in part, in a least restrictive manner, from a person with a disability who lacks capacity to make decisions in one or more important areas
